Terms of Service

These Terms of Service ("Terms") are the agreement between you and Sheikh Ventures LLC for your use of frAIgrant. Please read them. By creating an account or using the app or website, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use frAIgrant.

1. Acceptance of these Terms

By accessing or using the frAIgrant mobile app, the website at fraigrant.com, or any related service (together, the "Service"), you agree to be bound by these Terms. If you use the Service on behalf of someone else, you confirm that you are authorized to accept these Terms for them.

2. Who we are

frAIgrant ("frAIgrant," "we," "us," or "our") is operated by Sheikh Ventures LLC. frAIgrant is a fragrance social platform that helps you log your collection, rate fragrances, run head-to-head comparisons, and get personalized recommendations. You can reach us at hello@fraigrant.com.

3. Eligibility and age

You must be at least 17 years old to use frAIgrant. By using the Service you represent that you meet this requirement and that you are able to form a binding contract. The Service is not directed to children under 13, and we do not knowingly allow them to create accounts.

4. Your account

• You sign in with a passwordless magic link sent to your email. You are responsible for keeping access to that email secure and for activity that happens under your account.
• Provide accurate information, including a handle and display name that are not misleading or impersonating someone else.
• Tell us promptly at hello@fraigrant.com if you believe your account has been accessed without your permission.
• One person should not run accounts to evade a suspension or to abuse other users.

5. Acceptable use and zero tolerance for objectionable content

frAIgrant includes social features such as public profiles, follows, an activity feed, posts about what you are wearing, and user-submitted fragrance entries. There is zero tolerance for objectionable content or abusive behavior. When you use the Service, you agree that you will not:

• Post, upload, or share content that is unlawful, hateful, harassing, threatening, defamatory, sexually explicit, violent, or otherwise objectionable.
• Bully, harass, stalk, impersonate, or intimidate any person.
• Post spam, scams, malware, or deceptive links, or attempt to phish other users.
• Submit false fragrance data, manipulate ratings, or otherwise corrupt the catalog or recommendations.
• Infringe anyone's intellectual property, privacy, or other rights.
• Scrape, reverse engineer, overload, or interfere with the Service or its security, or access it through unauthorized automated means.
• Use the Service for any illegal purpose or in violation of any applicable law.

We may remove content and suspend or terminate accounts that violate this section, and we may do so without prior notice. We may report unlawful activity to the appropriate authorities.

6. Your content and how it is handled

You keep ownership of the content you create, such as your notes, ratings, posts, and submitted fragrance entries ("Your Content"). By posting Your Content, you grant frAIgrant a non-exclusive, worldwide, royalty-free license to host, store, display, and use it for the purpose of operating and improving the Service, including showing it to other users where you have chosen to make it visible. You are responsible for Your Content and confirm you have the rights needed to post it.

You can edit or delete most of Your Content in the app, and you can make your profile private so your collection is visible only to people who follow you. Deleting your account removes Your Content from our active systems as described in the Privacy Policy.

7. Reporting, blocking, and moderation

We want frAIgrant to feel safe. If you see content or behavior that breaks these Terms:

• Report it. Use the in-app report option where available, or email hello@fraigrant.com with details. We aim to review reports of objectionable content and act on them promptly, typically within 24 hours.
• Block users. Where the feature is available, you can block a user so you no longer see their activity or receive contact from them.
• Our action. We may remove content, issue warnings, restrict features, or remove users who violate these Terms. Repeat or serious violations can result in permanent removal.

8. AI features and recommendations

frAIgrant offers optional AI features, including bottle recognition, "Scent of the Day," "Ask frAIgrant," taste insights, and personalized recommendations, powered in part by Anthropic's Claude models. These features:

• Are provided for personal, informational purposes only. They are suggestions about fragrances, not professional, medical, allergy, or safety advice.
• Can be inaccurate or incomplete. Bottle recognition and recommendations may misidentify products or miss the mark. Always check the actual product before you buy or wear anything, and follow the manufacturer's guidance for use and allergens.
• Are optional. The Service remains usable without them.

You are responsible for decisions you make based on AI output. How we handle the data and photos these features use is described in the Privacy Policy.

9. "Where to buy" and affiliate links

Prices, availability, sizes, and stock shown for retailers are provided as a convenience and may be out of date or incorrect. The actual price and terms are set by the retailer at checkout, not by us. Purchases you make from a third-party retailer are between you and that retailer, and are governed by their terms and policies. frAIgrant is not the seller, does not fulfill orders, and is not responsible for third-party products, payments, shipping, returns, or customer service.

10. Purchases, subscriptions, and billing

frAIgrant's core features, including collection logging, ratings, the taste profile, core recommendations, social features, and "Where to buy" links, are free. We may offer optional paid features, which may include:

• Consumable credit packs (for example, additional bottle scans), which are used up as you use them and are not refundable once consumed.
• frAIgrant Plus, an auto-renewing subscription that unlocks premium features for a recurring fee.
• A one-time lifetime unlock, a single purchase that grants premium access.

Apple-managed billing. If you buy through the iOS app, payment is charged to your Apple Account and managed by Apple under Apple's terms, not by us. For auto-renewing subscriptions, your subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. You manage and cancel subscriptions, and request refunds, in your Apple Account settings. Removing the app does not cancel a subscription. Any unused portion of a free trial is forfeited when you buy a subscription that includes it. Prices are shown in the app before purchase and may change with notice for future billing periods.

Except where required by law or by Apple's policies, purchases are non-refundable. We may add, change, or discontinue paid features over time.

11. Intellectual property

The Service, including the frAIgrant name, logo, design, software, and the curated catalog and scoring, is owned by Sheikh Ventures LLC and protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the Service except as these Terms allow. Brand names and product names of fragrances belong to their respective owners and are used for identification only.

12. Third-party services

The Service relies on third parties such as Supabase, Anthropic, Netlify, Brevo, and weather data from Open-Meteo, and links to third-party retailers. We are not responsible for third-party services or websites, and your use of them is subject to their own terms. See the Privacy Policy for how data is shared with our service providers.

13. Suspension and termination

You may stop using frAIgrant at any time and can delete your account from within the app or by emailing us. We may suspend or terminate your access if you violate these Terms, if needed to protect users or the Service, or if we discontinue the Service. Sections that by their nature should survive termination, including content licenses you granted before deletion, intellectual property, disclaimers, limitation of liability, and indemnification, will survive.

14. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, that recommendations or bottle identifications will be accurate, or that catalog or retailer information will be complete or current. Fragrance and cosmetic products can cause skin or allergy reactions; you are responsible for checking ingredients and using products safely.

15. Limitation of liability

To the fullest extent permitted by law, Sheikh Ventures LLC and its owners and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or related to your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the 12 months before the claim, or 50 US dollars. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Sheikh Ventures LLC and its owners from claims, damages, losses, and reasonable legal fees arising out of your content, your use of the Service, or your violation of these Terms or of any law or third-party right.

17. Apple App Store terms

If you download frAIgrant from the Apple App Store, the following additional terms apply:

• These Terms are between you and Sheikh Ventures LLC only, not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the app.
• Apple is not responsible for addressing claims relating to the app, including product liability, legal or regulatory compliance, or consumer protection claims.
• Apple is not responsible for third-party claims that the app or your use of it infringes intellectual property rights.
• You represent that you are not located in a country subject to a US Government embargo and are not on any US Government restricted-parties list.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

18. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your place of residence apply. You agree to first try to resolve any dispute informally by contacting us at hello@fraigrant.com. Any dispute that is not resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in New York, unless applicable law requires otherwise.

19. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for significant changes, provide notice in the app or by email. Continued use of frAIgrant after an update means you accept the revised Terms.
